1. Overview
AI Front Desk, Inc. ("AI Front Desk", "we", "us", or "our") provides AI-powered calling, texting, and automation services. To keep the Service safe, lawful, and useful for everyone, we require all users to follow this Acceptable Use Policy. The restrictions below are not exhaustive; we may take action against any conduct we reasonably believe is harmful, unlawful, or contrary to the spirit of these rules.
2. Scope and Incorporation
This AUP applies to all use of the Service, including inbound calls, outbound calls, text messaging, email, sequences, automations, voice configuration, and any other feature offered by AI Front Desk. It applies whether the Service is accessed directly or through a reseller, integration, or API. By using the Service, you agree to comply with this AUP and to ensure that anyone using the Service under your account also complies.
3. Unsolicited Communications
You may not use the Service to:
- Make unsolicited cold calls, including any outbound calls to recipients who have not given prior express consent or with whom you do not have an established business relationship as defined under applicable law.
- Send unsolicited cold text messages, SMS, MMS, or RCS communications, including marketing messages, prospecting messages, or any other commercial message that is not permitted under the TCPA, the TSR, the CAN-SPAM Act, or analogous state and non-U.S. laws.
- Use Sequences or any other automation feature to scale unsolicited outbound activity, whether by volume, frequency, or recipient count.
- Continue contacting any recipient who has asked to stop receiving communications, through any channel, regardless of how the opt-out was expressed.
4. Consent and Established Business Relationship
You represent and warrant that, for every recipient in any outbound campaign or Sequence, you have obtained valid prior express consent (or have a documented established business relationship) sufficient to satisfy the most restrictive applicable law. You are solely responsible for collecting, storing, and producing on request evidence of such consent. AI Front Desk does not collect or maintain consent records on your behalf and does not verify the consent status of recipients in your lists.
5. Do Not Call Records and Opt-Outs
You are solely responsible for maintaining your own Do Not Call (DNC) list, scrubbing your recipient lists against all applicable federal, state, and internal DNC registries, and honoring opt-out requests received through any channel (voice, SMS, email, web, or in-person). Opt-outs must be honored promptly and across all future Sequences, campaigns, and channels, not just the channel through which they were received. AI Front Desk does not maintain a centralized DNC list on your behalf.
6. Voice Cloning and Impersonation
You may not use the Service to clone, replicate, imitate, or otherwise reproduce the voice of any real person without that person's explicit, verifiable, written authorization. This restriction applies to all uses of the Service, and applies most strictly to outbound calling. Where AI Front Desk offers a voice library, only voices that AI Front Desk has approved as licensed or synthetic may be used for outbound calls.
You may not use the Service to impersonate any business, government agency, individual, or other organization, or to misrepresent your affiliation with any of the foregoing. You may not configure the Service to suggest an outbound call is being conducted by a specific identifiable human when it is not.
You acknowledge that unauthorized voice replication and impersonation may create liability under the Tennessee ELVIS Act, New York digital replica laws, Illinois BIPA, California AB 2602, and similar laws. You are solely responsible for compliance with these laws, and you indemnify AI Front Desk against any related claims under Section 32.6 of the Terms and Conditions.
7. AI Disclosure on Calls
You may not disable, alter, or circumvent AI disclosure messages that the Service plays on outbound calls except as expressly permitted by AI Front Desk's account settings, and only where doing so complies with all applicable laws (including, where applicable, the Texas AI disclosure requirement, proposed FCC rules, and analogous state and non-U.S. requirements). You remain solely responsible for ensuring that every outbound call discloses the use of AI as required by law, regardless of any default behavior of the Service.
8. Prohibited Content and Conduct
You may not use the Service to send, host, or generate any content that:
- Is unlawful, fraudulent, deceptive, defamatory, obscene, harassing, threatening, hateful, or designed to incite violence or discrimination.
- Promotes or facilitates illegal activity, including illegal drugs, weapons, gambling where prohibited, or evasion of taxes or sanctions.
- Infringes any intellectual property, publicity, privacy, or other right of any third party.
- Constitutes phishing, smishing, vishing, social engineering, scams, or any attempt to deceive a recipient into disclosing credentials, payment information, or sensitive personal data.
- Targets minors with marketing or any age-inappropriate content.
- Makes calls or messages to emergency telephone lines, public safety answering points, hospitals or other healthcare facilities, or any line for which the called party is charged for the communication.
9. Platform Integrity and Security
You may not:
- Attempt to access, probe, scan, or test the vulnerability of the Service, any account other than your own, or any system or network connected to the Service, without express authorization from AI Front Desk.
- Interfere with, disrupt, or impose an unreasonable load on the Service, including through denial-of-service, traffic flooding, or sustained abuse of rate limits.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the Service except to the extent permitted by applicable law.
- Use any bot, scraper, or other automated means to access the Service except through documented APIs and within their documented rate limits.
- Resell, sublicense, or expose the Service to third parties except under an authorized reseller arrangement with AI Front Desk.
- Use the Service to develop a product or service that competes with AI Front Desk.
10. Monitoring and Enforcement
We may monitor use of the Service for compliance with this AUP, the Terms and Conditions, and applicable law. Monitoring may include, without limitation, review of call recordings and transcripts, message bodies, recipient lists, delivery patterns, complaint signals, and any other data generated by your use of the Service. We have sole discretion to determine whether a use complies with this AUP.
10.1. Right to Pause or Disable
AI Front Desk reserves the right, at its sole discretion and without prior notice, to pause, throttle, suspend, or disable any Sequence, campaign, account feature, or account that we reasonably believe violates this AUP, the Terms and Conditions, or applicable law, or that poses a risk to the platform, to AI Front Desk, or to call or message recipients. We may take this action immediately and without warning. We are not liable for any losses, missed opportunities, or other damages resulting from such action.
10.2. Cooperation with Authorities
We reserve the right to cooperate with law enforcement and regulators in any investigation of suspected illegal, fraudulent, or improper use of the Service, including by disclosing account information and use data as permitted or required by law.
11. Reporting Violations
If you believe someone is using the Service in violation of this AUP, please report it to abuse@myaifrontdesk.com. Include enough detail (date, time, phone number, message body, screenshots) for us to investigate.
12. Changes to This Policy
We may update this AUP from time to time. When we make material changes, we will update the effective date above and may require you to re-accept the updated AUP and the Terms and Conditions before continuing to use the Service. Continued use of the Service after the effective date of an updated AUP constitutes acceptance of the updated policy.
